These Terms of Service (“Terms”) are a legal agreement between you and DZ English Courses (“we”, “us”, “our”) governing your use of the Development Zenith mobile application, the digital companion to DZ English Courses (the “App”). By downloading, creating an account, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Who we are
The App is provided by Dagmara Zimnoch, trading as DZ English Courses (sole trader), based in Peterborough, United Kingdom (full postal address available on request), contact support@dzenglishcourses.com.
Eligibility
The App is intended for adult learners (18+). By using it you confirm you are old enough to enter into these Terms and to consent to the processing of your data as described in our Privacy Policy.
Your account
- You must provide accurate information when registering and keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You may hold one account for your personal use and must not share it or let others use it.
- Tell us promptly at support@dzenglishcourses.com if you suspect unauthorised use of your account.
The service
The App provides self-study English-learning features, including guided lessons across levels A1–C2, vocabulary flashcards, and personal progress tracking. Features, content and availability may change, improve or be withdrawn over time.
Course and corporate access (class codes)
If you are a student of DZ English Courses or of an organisation that uses the App, you may enter a class code to join a class. In that case:
- Your teacher or organisation administrators can set you assignments and can see your enrolment, your submissions, and your progress within that class.
- Other students in your class can see a leaderboard showing your first name, the initial of your surname and your total XP (see our Privacy Policy for detail).
- Your teacher may grant your class access to bespoke, course-only study material (for example our idioms, phrasal verbs and language-function sets) — see section 7.
- Access to class features depends on your continued enrolment and may be removed by your teacher or organisation, or may end automatically on a course end date your organisation's administrator has set for your access.
Acceptable use
You agree not to:
- use the App for any unlawful purpose or in breach of these Terms;
- copy, scrape, resell, or redistribute the App's content;
- attempt to reverse-engineer, decompile, interfere with, or gain unauthorised access to the App or its systems;
- upload unlawful, infringing, offensive, or harmful content; or
- misuse the App in a way that harms other users or us.
We may suspend or terminate your access if you breach these Terms.
Content and intellectual property
- Our content. The App, and all lessons, exercises, text, graphics, logos and software in it, are owned by us or our licensors and are protected by intellectual-property laws. This includes bespoke, course-only material (such as our idioms, phrasal verbs and language-function content) that your teacher may make available to your class — it is licensed to you for personal study only. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App and its content for your own learning; you may not copy, share outside your class, or redistribute it (see section 6).
- Your content. You keep ownership of the flashcards and submissions you create. You grant us a licence to host, store and process that content as needed to operate the App and provide the service (including sharing your submissions with your teacher, where relevant). You are responsible for the content you submit and confirm you have the right to submit it.
Fees
The App is currently free to download and use. We may introduce optional paid features or subscriptions in future. If we do, the price and terms will be shown to you before you buy, and any purchase will be processed by Google Play under its own terms; we do not collect your payment-card details.
Third-party services
The App is distributed through Google Play and relies on third-party infrastructure (including Supabase) to operate. Your use of those services is also subject to their own terms and policies.
Disclaimers
The App is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free, and we do not guarantee any particular learning outcome, exam result, or level of English proficiency. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.
Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law. Subject to that, we are not liable for any loss of data, loss of profits, or indirect or consequential loss arising from your use of, or inability to use, the App.
Termination and account deletion
You may stop using the App and request account deletion at any time — in the App (Settings → Delete account) or, without the App, via our public account-deletion page or by emailing support@dzenglishcourses.com. We may suspend or end your access if you breach these Terms or if we stop providing the App. Deletion is handled as described in our Privacy Policy, including the 14-day recovery window before permanent removal.
Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and, for significant changes, provide a more prominent notice. Continuing to use the App after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer-protection rights you have where you live.
